1. Champ d'application
Les présentes Conditions Générales de Vente (CGV) s'appliquent à :
- PromoTracker : Plateforme SaaS de gestion de campagnes musicales proposée par abonnement
- ArtistKit : Plugin WordPress de promotion musicale disponible en version Pro par licence payante
Ces CGV régissent la vente et l'utilisation des services PromoTracker et ArtistKit entre l'éditeur (David Cohen) et l'utilisateur (client).
2. Plans et tarification PromoTracker
PromoTracker est disponible en trois plans d'abonnement :

Les tarifs sont affichés lors du processus d'achat et facturés via Stripe. Les prix sont en EUR (euros) sauf indication contraire.
3. ArtistKit Pro
ArtistKit Pro est disponible comme licence payante via un lien de paiement Stripe :
- Type : Licence perpétuelle (achat unique, pas d'abonnement récurrent)
- Activation : Basée sur l'email de la licence
- Paiement : Sécurisé via Stripe Payment Link
- Activations multiples : Une licence par email ; les activations supplémentaires sont proposées à prix réduit
4. Conditions de paiement
- Méthode : Stripe (cartes bancaires, e-wallets, virements, selon disponibilité par région)
- Sécurité : Tous les paiements sont cryptés et traités de façon sécurisée par Stripe
- Facturation : Pour les abonnements PromoTracker, la facturation est récurrente selon le cycle choisi (mensuel, annuel, etc.)
- Données bancaires : Les données bancaires ne sont jamais stockées par PromoTracker ; elles sont gérées exclusivement par Stripe
5. Droit de rétractation
Délai de rétractation : 14 jours calendaires à partir de la date d'achat/d'activation du service
Selon la directive européenne sur les services numériques, vous avez le droit de vous rétracter de votre achat dans un délai de 14 jours, avec les exceptions suivantes :
- Si vous avez explicitement accepté que le service commence avant la fin du délai de rétractation, le droit de rétractation disparaît
- Pour les abonnements, la rétractation s'applique au premier cycle de facturation ; les cycles suivants continuent selon les conditions
Comment exercer votre droit : Envoyez un email à hello@promotracker.fr avec votre demande de rétractation et votre numéro de commande.
6. Politique de remboursement
- Les remboursements sont traités via le même moyen de paiement initial
- En cas de rétractation dans les 14 jours : remboursement complet
- Au-delà de 14 jours : aucun remboursement, sauf en cas de défaillance technique du service
- Pour les défaillances techniques : contactez hello@promotracker.fr pour une évaluation
- Les délais de remboursement dépendent de votre banque (typiquement 5-10 jours ouvrables)
7. Disponibilité du service
- PromoTracker s'engage à assurer une disponibilité maximale du service, cible 99.5%
- Des interruptions temporaires peuvent survenir pour maintenance, mise à jour, ou circonstances indépendantes de notre volonté
- Notification : Les maintenances prévues sont annoncées à l'avance si possible
- PromoTracker ne garantit pas une disponibilité sans interruption et décline toute responsabilité pour les dommages causés par l'indisponibilité du service
8. Propriété intellectuelle
- PromoTracker : Plateforme, code, design, et contenu sont protégés par les droits d'auteur et la propriété intellectuelle de l'éditeur
- Contenu utilisateur : Vous conservez les droits sur vos données de campagne ; PromoTracker a le droit d'utiliser ces données de façon anonymisée pour améliorer le service
- ArtistKit : Le plugin est licencié (non vendu) ; vous acquérez le droit d'utilisation, pas la propriété
- Interdictions : Vous n'êtes pas autorisé à reproduire, modifier, décompiler, ou distribuer PromoTracker ou ArtistKit sans autorisation
9. Limitation de responsabilité
PromoTracker et ArtistKit sont fournis "en l'état" sans garantie supplémentaire. PromoTracker décline toute responsabilité pour :
- Perte de données, pertes financières, ou dommages indirects
- Utilisation inappropriée du service ou non-conformité à ces CGV
- Actions de tiers ou circonstances hors de notre contrôle
- Interruptions du service ou indisponibilité temporaire
Limitation globale : La responsabilité totale de PromoTracker ne peut pas dépasser le montant total que vous avez payé pour le service au cours des 12 derniers mois.
10. Résiliation et suppression de compte
- Résiliation par l'utilisateur : Vous pouvez résilier votre abonnement PromoTracker à tout moment via les paramètres du compte ou par email
- Effet : La résiliation prend effet à la fin du cycle de facturation en cours
- Données : Après résiliation, vos données seront conservées selon notre Politique de Confidentialité
- Suppression de compte : Vous pouvez demander la suppression complète de votre compte via hello@promotracker.fr
11. Conduct and Restrictions
En utilisant PromoTracker ou ArtistKit, vous vous engagez à :
- Respecter la loi applicable
- Ne pas utiliser le service à des fins illégales ou nuisibles
- Ne pas tenter d'accès non autorisé ou de piratage
- Ne pas distribuer de contenu offensant, discriminatoire, ou contrefait
- Respecter les droits d'auteur et la propriété intellectuelle de tiers
Violation de ces conditions peut entraîner la suspension ou la suppression de votre compte sans remboursement.
12. Droit applicable et juridiction
- Loi applicable : Loi française
- Juridiction : Tribunal de Pontoise (Val-d'Oise, France)
En cas de litige, nous chercherons d'abord une résolution amiable. Si la résolution amiable échoue, le différend sera soumis aux tribunaux compétents français.
13. Modifications des CGV
PromoTracker se réserve le droit de modifier ces CGV à tout moment. Les modifications seront publiées sur cette page avec une date de prise d'effet. L'utilisation continue du service après les modifications signifie votre acceptation des nouvelles CGV.

These Terms of Sale govern the sale and use of PromoTracker and ArtistKit services between the publisher (David Cohen) and the user (customer).
2. PromoTracker Plans and Pricing
PromoTracker is available in three subscription plans :

Prices are displayed during the checkout process and billed via Stripe. Prices are in EUR (euros) unless otherwise specified.
3. ArtistKit Pro
ArtistKit Pro is available as a paid license via a Stripe Payment Link :
- Type : Perpetual license (one-time purchase, no recurring subscription)
- Activation : Based on the license email
- Payment : Secure via Stripe Payment Link
- Multiple Activations : One license per email ; additional activations are offered at a reduced price
4. Payment Terms
- Method : Stripe (credit cards, e-wallets, transfers, depending on regional availability)
- Security : All payments are encrypted and securely processed by Stripe
- Billing : For PromoTracker subscriptions, billing is recurring according to the chosen cycle (monthly, annual, etc.)
- Banking Data : Banking data is never stored by PromoTracker ; it is handled exclusively by Stripe
5. Right of Withdrawal
Withdrawal period : 14 calendar days from the date of purchase/activation of the service
According to the European directive on digital services, you have the right to withdraw from your purchase within 14 days, with the following exceptions :
- If you have explicitly agreed that the service begins before the end of the withdrawal period, the right of withdrawal disappears
- For subscriptions, withdrawal applies to the first billing cycle ; subsequent cycles continue according to the terms
How to exercise your right : Send an email to hello@promotracker.fr with your withdrawal request and order number.
6. Refund Policy
- Refunds are processed via the same original payment method
- In case of withdrawal within 14 days : full refund
- Beyond 14 days : no refund, except in case of technical service failure
- For technical failures : contact hello@promotracker.fr for assessment
- Refund timelines depend on your bank (typically 5-10 business days)
7. Service Availability
- PromoTracker commits to ensuring maximum service availability, target 99.5%
- Temporary interruptions may occur for maintenance, updates, or circumstances beyond our control
- Notification : Scheduled maintenance is announced in advance if possible
- PromoTracker does not guarantee uninterrupted availability and disclaims responsibility for damages caused by service unavailability
8. Intellectual Property
- PromoTracker : Platform, code, design, and content are protected by copyright and intellectual property of the publisher
- User Content : You retain rights to your campaign data ; PromoTracker has the right to use this data in anonymized form to improve the service
- ArtistKit : The plugin is licensed (not sold) ; you acquire usage rights, not ownership
- Prohibitions : You are not authorized to reproduce, modify, decompile, or distribute PromoTracker or ArtistKit without authorization
9. Limitation of Liability
PromoTracker and ArtistKit are provided "as is" without further warranty. PromoTracker disclaims responsibility for :
- Data loss, financial losses, or indirect damages
- Misuse of the service or non-compliance with these Terms
- Actions by third parties or circumstances beyond our control
- Service interruptions or temporary unavailability
Overall limitation : PromoTracker's total liability cannot exceed the total amount you have paid for the service over the past 12 months.
10. Termination and Account Deletion
- Termination by user : You can terminate your PromoTracker subscription at any time via account settings or by email
- Effect : Termination takes effect at the end of the current billing cycle
- Data : After termination, your data will be retained according to our Privacy Policy
- Account deletion : You can request complete account deletion via hello@promotracker.fr
11. Conduct and Restrictions
By using PromoTracker or ArtistKit, you commit to :
- Comply with applicable law
- Not use the service for illegal or harmful purposes
- Not attempt unauthorized access or hacking
- Not distribute offensive, discriminatory, or counterfeit content
- Respect the copyright and intellectual property rights of third parties
Violation of these conditions may result in suspension or deletion of your account without refund.
12. Applicable Law and Jurisdiction
- Applicable Law : French law
- Jurisdiction : Tribunal de Pontoise (Val-d'Oise, France)
In case of dispute, we will first seek amicable resolution. If amicable resolution fails, the dispute will be submitted to the competent French courts.
13. Modifications to Terms
PromoTracker reserves the right to modify these Terms at any time. Modifications will be posted on this page with an effective date. Continued use of the service after modifications signifies your acceptance of the new Terms.
